Schalast | Tax

Within our practice, tax law serves two primary functions. On the one hand, it plays a supporting role in transactions, particularly in the areas of banking and finance, corporate law, M&A, and real estate. On the other hand, our tax practice addresses complex, standalone tax matters for our clients.

Our expertise includes specialized areas such as investment fund taxation, financial transaction taxes, and representation in tax litigation before German tax courts. A key focus of our practice is also U.S. tax law, with particular emphasis on Qualified Intermediary (QI) regulations.

We are committed to delivering practical, forward-looking solutions that meet the expectations of tax authorities and align with the requirements of modern tax compliance management systems.

Beyond advisory services in niche areas, our team also manages reporting obligations through the Federal Tax Agency’s portals (e.g., DAC 6, CRS, FATCA) and conducts periodic reviews for QI compliance. To support these efforts, we have developed proprietary software solutions tailored to these needs.

Mr. von Schweinitz, a member of the OECD Working Party 10 on international tax law, ensures that we stay at the forefront of developments in this rapidly evolving field.

Typical assignments in the area of tax focuses are:

  • Advising on banking and financing products and their tax structuring
  • Guidance on the application of tax treaties, particularly in the context of fund structuring (e.g., NPL funds or litigation funding)
  • U.S. tax law advice, including U.S. filings (1042/1042-S) and taxation of U.S. derivatives
  • Development and implementation of tax compliance programs
  • Support during tax audits, administrative proceedings, and tax litigation
